1. Scope

The following terms and conditions apply to all orders placed via our online store.

Our online store is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

When the contract with us is concluded depends on the payment method you have selected:

When you place your order, you also send us your credit card details. After you have been legitimized as the legal cardholder, we will ask your credit card company to initiate the payment transaction and thereby accept your offer.

PayPal, PayPal Express
During the ordering process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the store we request PayPal to initiate the payment transaction and thereby accept your offer.

Sofort by Klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This concludes the contract with us.

Google Pay
During the order process, you will be redirected to the website of the provider Google before completing the order process in our online store. There you can select the delivery address and payment method stored with Google and confirm the payment instruction to Google. You will then be redirected back to our online store, where you can complete the order process. After placing the order, we will ask Google to initiate the payment transaction and thereby accept your offer.

3. Contract language, Contract text storage
The language available for the conclusion of the contract is German and English. We save the text of the contract and send you the order data and our GTC by e-mail.

4. Delivery conditions / Shipping
Deliveries are only possible to delivery addresses within the country selection. We reserve the right to add or remove countries from the selection list at any time.

The shipping costs are shown separately for each region.

In the event of a new shipment due to an incorrectly entered address by the buyer, we reserve the right to claim the flat-rate shipping costs retrospectively. The flat rate depends on the respective country costs. It is the buyer's responsibility to check all details before completing the order process.

5. Payment
In our webshop the following payment methods are available to you:

In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort banking account with PIN/TAN procedure, legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Google Pay
During the order process, you will be redirected to the website of the provider Google before completing the order process in our online store. In order to complete the order process via Google and pay the invoice amount you must be registered there or first register and legitimize yourself with your access data. 6. Reservation of Ownership
The goods remain our property until full payment has been made.

7. Transport Damage
If goods are delivered with obvious transport damage, please complain about such defects to the deliverer immediately and contact us without delay. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.

8. Warranty and Guarantees
The statutory liability for defects applies.
The following applies to used goods: If the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects, which occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.

9. Legal Right of Withdrawal

The legal right of withdrawal is mandatory for both parties. This applies with priority and for 14 working days from the date of delivery.

10. Undeliverable Shipment
If your order cannot be delivered after several attempts for reasons beyond our control, it will be returned to us. In this case, we will assume that you wish to withdraw from the contract, which will then automatically be converted into a return debt relationship. As a consequence, we will immediately, but no later than 14 days after withdrawal, refund all payments received from you, excluding shipping costs (with the exception of additional costs resulting from the fact that you have chosen a shipping method other than the standard shipping method offered by us).

11. Discounts & Discount Codes

Each discount code can only be used once per purchase and per customer.

Only one discount code can be used per order. It is not possible to combine different discount codes. It is not possible to combine bundles and discount codes.

Validity:

The validity period of the discount codes is limited. The discount codes lose their validity after the date stated on the discount code. Renewal is excluded.

Return of Items:

If you make use of your right of withdrawal or return the goods for other reasons, only the reduced purchase price will be refunded. There is no entitlement to a refund of the discount code or to a new discount code.

Settlement for Several Items:

If an order to which a discount code is applied consists of several items (shopping cart discount), we reserve the right to divide the discounted amount between one or more items.

Non-fulfillment of an Order or Shipment:

If the order or individual items to which the discount code related are not fulfilled, there is no entitlement to reimbursement of the value of the discount code or entitlement to a new discount code.

12. Liability

      The foregoing limitations and reductions of time periods shall not apply to claims based on damage caused by us, our legal representatives or vicarious agents. In this case, we shall always be liable without limitation:

      • in the event of injury to life, limb or health,
      • in the event of intentional or grossly negligent breach of duty,
      • in the case of guarantee promises, if agreed, or
      • insofar as the scope of application of the Product Liability Act applies.
        In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.


        13. Dispute Settlement
        The European Commission provides a platform for online dispute resolution (ODR), which you can find here https://ec.europa.eu/consumers/odr.
        We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and are not prepared to do so.
